Terms of Use

Clients provide their consent in that these Terms & Conditions constitute a legally binding agreement between yourself and Segura Emporium concerning your access to and use of segura.com.na and the services Segura has to offer.

By purchasing any service or product on our website, you consent thereto that we may amend this Agreement at any time by posting the amended terms on our website.

Content Disclaimer

Postings on our Website are made at such times as we determine in our discretion. You should not assume that the information contained on our Website has been updated or otherwise contains current information. We do not review past postings to determine whether they remain accurate and information contained in such postings may have been superseded. Although we try and maintain stock on hand as far as possible, we will inform you should a product you ordered no longer be available.

Refunds for Services

We do not issue cash refunds for any product. An exchange or voucher will be issued for purchased products within 7 days of the product being received. Vouchers will be valid for a period of 6 months.

An exchange or voucher will only be entertained and issued once inspection of the product has been completed and the product has been received back in good order. Products should thus be returned in the original undamaged packaging, with tags attached to items. Clients will not be refunded if any tags have been removed from products or of the packaging was damaged by the client.

Segura will bear the cost for all return expenses, if the client adheres to the abovementioned.

Damaged Products

A voucher or replacement product will be sent to the Client if a product is damaged upon delivery.

An internal investigation will be conducted before rectifying the situation to determine whether the product delivered was damaged. We do not take responsibility for any damage caused by the courier company or the Client directly.

Disclaimer of Warranties and Limitation of Liability

Products are developed and manufactured by third parties. Although we take the utmost care in ensuring clients receive products of a high quality, errors may occur. Should a product not meet the desired quality standard, we will facilitate an exchange or issue the Client with a voucher for use within 6 months. Without limiting the Disclaimer of Warranties and Limitation of Liability terms in our Conditions of Use, unless otherwise required by applicable law, in no event will our or our licensors’ aggregate liability with respect to any claim arising from or related to this Agreement or your use thereof.

Indemnification

You agree to defend, indemnify and hold us harmless from and against any and all claims, damages, costs and expenses, including attorneys’ fees, arising from or related to your use of our Website or any Products you purchase through it.

Our inclusion of links to a Third-Party Website does not imply any endorsement of the material on our Website or, unless expressly disclosed otherwise, any sponsorship, affiliation or association with its owner, operator or sponsor, nor does our inclusion of the links imply that we are authorized to use any trade name, trademark, logo, legal or official seal, or copy- written symbol that may be reflected in the linked Third-Party Website.

Termination and/or Cancellation

Your rights under this Agreement will automatically terminate without notice if you fail to comply with any of its terms. In case of such termination, Segura may immediately revoke your access to our services. Segura’s failure to insist upon or enforce your strict compliance with this Agreement will not constitute a waiver of any of its rights.

Clients are permitted to cancel an order at any time provided they do so before receiving a dispatch notice. For cancellation the client must email info@segura.com.na to cancel an order, stating the order number for purposes of cancellation. Orders will automatically be cancelled if payment has not been affected within 48 hours after your order has been placed.

Limited License

We grant you a non-exclusive, non-transferable, revocable license to access and use our Website and Services, for you to make purchases of certain products and related Services through our Website, strictly in accordance with our Agreement.

Copyrights and Trademarks

Unless otherwise noted, all materials including without limitation, logos, brand names, images, designs, photographs, video clips and written and other materials that appear as part of our Website are copyrights, trademarks, service marks, trade dress and/or other intellectual property whether registered or unregistered (“Intellectual Property”) owned, controlled or licensed by us. Our Website is protected by copyright. Nothing on our Website should be construed as granting, by implication, estoppel or otherwise, any license or right to use any Intellectual Property displayed or used on our Website, without the prior written permission of the Intellectual Property owner. The names and logos of us, may not be used in any way, including in advertising or publicity pertaining to distribution of materials on our Website, without prior, written permission from us. Other product and company names mentioned in our Website may be the Intellectual Property of their respective owners.

General

Prices of products may change at any time without prior notice. We are not responsible for information which is entered incorrectly by the client on the site, whether this is in the form of an address, personal details, cell phone number etc.

Privacy Policy

We confirm that we will at no time, without the consent of the client, share their personal information with anyone outside of the company, with the exception being delivery information given to the courier company, used to deliver our products to you.

If the Client elects to rate or review a product, they grant us permission to use their rating/review as we deem fit. The review and the customer’s name and photo may be used for newsletters, on our website or for any other means we deem fit. Personal information will be treated with strict confidentiality.

We do not own the information provided by the Client and as such we will never sell any Client information.

Whilst we will do all things reasonably necessary to protect your rights of privacy, we cannot guarantee or accept any liability whatsoever for unauthorised or unlawful disclosures of your personal information, whilst in our possession, made by third parties who are not subject to our control, unless such disclosure is as a result of our gross negligence.

Deliveries

We guarantee that your product will be delivered to your doorstep within 4 business days from your order being place. Please ensure that the address you provide is accurate.

Deliveries in Windhoek will be free of charge.

Deliveries to other parts of Namibia will be made by a courier company and the costs thereof will be borne by the Client.
